Rewards & Membership Terms

These Terms and Conditions (the "Program Terms") govern Maccland Rewards and The Extra Batch™ (together, the "Program"), operated by THEMACCS, LLC, 220 Coster Street, Bronx, NY 10474, United States ("The Maccs," "we," "us," or "our"). By creating an account, placing an order, purchasing a membership, or earning or redeeming Hearts, you agree to these Program Terms, our Terms of Service, and our Privacy Policy. If these Program Terms conflict with our Terms of Service, these Program Terms control for anything related to the Program.

1. Eligibility

• The Program is open to residents of the United States who are 18 years of age or older.
• Each person may hold one account and one membership. Accounts, memberships, and Hearts are personal and may not be shared, sold, or transferred.
• You must provide accurate account information, including your name, email address, and (if you choose to share it) your birthday.

3. Maccland Rewards (Free Plan)

• Maccland Rewards is free. You are enrolled automatically when you create an account or place your first order.
• All existing customers are enrolled automatically on the date Maccland Rewards launches.
• Members earn 1 Heart for every $1 spent, as described in Section 5.

4. The Extra Batch™ (Paid Plans)

4.1 Joining

The Extra Batch is purchased as a product on themaccs.com. Your membership activates automatically once your purchase is complete. While Founding Offer spots remain, you may choose either the Annual plan or the Founding Offer. Once all Founding Offer spots are claimed, only the Annual plan is offered.

4.2 The Extra Batch™ (Founding Offer)

• The Founding Offer is a one-time payment of $100 for lifetime membership.
• It is limited to 500 members. Spots are assigned in the order purchases are completed. Once 500 spots are claimed, the Founding Offer closes and is no longer available.
• "Lifetime" means for as long as The Extra Batch program is offered by The Maccs, subject to Section 11.

4.3 The Extra Batch™ (Annual)

• The Annual plan costs $50 per year.
• Your Annual membership renews automatically each year and is charged to the payment method on file on your renewal date, until you cancel. We will notify you before any change to the annual price takes effect.
• You can manage or cancel your plan at any time in My Account. To avoid your next renewal charge, cancel before your renewal date. After you cancel, your membership stays active until the end of the year you have already paid for.
• When an Annual membership ends, whether you cancel or a renewal payment fails, your account moves to Maccland Rewards. Your Hearts balance carries over, and you earn at the Maccland Rewards rate from then on.

4.4 Switching from Annual to the Founding Offer

While Founding Offer spots remain, Annual members may switch to the Founding Offer by purchasing it at its full price. No credit is given for Annual payments already made.

4.5 Upgrading from Maccland Rewards

When you join The Extra Batch, your existing Hearts balance carries over to your membership, and you stop earning at the Maccland Rewards rate.

4.6 No Refunds

All membership purchases are final. Membership fees, including Founding Offer payments and Annual renewal charges, are non-refundable, and we do not offer partial refunds or credits for unused time.

5. Earning Hearts

• Purchases: Hearts are earned on the order subtotal after discounts, excluding shipping and taxes. Maccland Rewards members earn 1 Heart per $1. Extra Batch members earn 2 Hearts per $1.
• Subscriptions: Subscription renewal orders earn Hearts the same way as one-time orders.
• Gift cards: Gift card purchases earn Hearts, and orders paid for with gift cards also earn Hearts.
• Membership purchases: Purchasing an Extra Batch membership does not earn Hearts.
• Hearts are added to your account after your order is placed and may take some time to appear.

6. Bonus Hearts

• Welcome bonus: 75 Hearts when you join Maccland Rewards, and another 75 Hearts when you join The Extra Batch.
• Instagram follow: 25 Hearts, one time, for following @the.maccs on Instagram. To qualify, you must be logged in, click the Instagram link in the Bonus Points list in the rewards menu, and then follow the account. This connects your Instagram account to your account email address. Follows made any other way cannot be rewarded. Please allow time for these Hearts to appear.
• Birthday: 25 Hearts each year on your birthday, on all plans. To receive them, your birthday must be saved to your account before your birthday passes. You can add it when prompted during sign-up or at any time in My Account. Please allow time for these Hearts to appear.
• Reviews: 25 Hearts for each review you write. To qualify, reviews must be submitted through the TrustShop Reviews app on themaccs.com.
• Referrals: 150 Hearts for each successful referral, as described in Section 8.

We reserve the right to change the review platform that qualifies for bonus Hearts, and to change the ways bonus Hearts can be earned, at any time.

7. Redeeming Hearts

7.1 How Redemption Works

• Hearts can only be redeemed through the rewards menu in My Account. A minimum balance of 150 Hearts is required to redeem.
• Hearts cannot be applied as an open-ended discount or exchanged for cash.

7.3 Reward Conditions

• Store credit: Applied to your account by our team. Store credit cannot be applied to subscription renewal orders.
• Free 4-packs and 12-packs: Must be added to a paid order. They are never shipped on their own.
• Free shipping: Requires a minimum order of $36. Codes are single use and expire 48 hours after they are issued. If a code expires unused, the Hearts are returned to your account. Each member may hold one free shipping code at a time.

8. Referrals

• Share your referral link with a friend. Your friend receives 10% off their first order.
• Your friend must be a new customer creating a new account. You cannot refer yourself.
• You earn 150 Hearts when your friend uses their referral discount on an order with a subtotal of $36 or more.
• There is no limit to the number of referrals that can earn Hearts.

9. The Extra Batch™ Member Perks

The following perks are available to active Extra Batch members, on both the Annual plan and the Founding Offer:

• Free shipping on your first member order: One use, on an order placed within 30 days of joining. The order must meet the site's standard minimum order of $24.
• Free birthday 4-pack: A free 4-pack added to any paid order placed within 30 days of your birthday. Your birthday must be saved to your account before your birthday passes.
• The secret menu: Access to a members-only menu of 10 flavors that are not sold to non-members.
• New flavor drops: Members vote on new flavors on a schedule we set. The winning flavor is available exclusively to members for 30 days, then becomes available to everyone.
• Keep a limited-time flavor: Put any limited-time Macc on an active subscription and we'll keep making it for you year round.

10. Shipping Discounts, Expiration, and Adjustments

10.1 One Shipping Discount per Order

Only one shipping discount can be applied to an order. If more than one applies (for example, a Hearts free shipping reward and a member perk), the larger discount is used.

10.2 Hearts Expiration

Hearts expire after 12 months with no activity on your account. Activity means earning or redeeming Hearts. Any activity resets the 12-month period. This applies to all plans.

10.3 Refunds and Adjustments

If an order is refunded, the Hearts earned on that order are deducted from your balance. We may also correct any Hearts credited in error.

10.4 No Cash Value

Hearts, rewards, and store credit have no cash value. They cannot be sold, transferred, or exchanged for cash, and they are not your property.

11. Changes to the Program

• We may change, suspend, or end the Program, any plan, the rewards menu, earning rates, bonuses, or member perks. We will give at least 30 days' notice by email or on themaccs.com before a material change or the end of the Program takes effect.
• If the Program ends, Hearts not redeemed before the end date will be forfeited. Founding Offer memberships end when the Program ends.
• We may update these Program Terms from time to time. The "Last updated" date above shows when they last changed. Continuing to take part in the Program after an update means you accept the updated Program Terms.

12. Fraud and Misuse

We may suspend or close an account, cancel a membership, and remove Hearts, rewards, or perks if we reasonably believe the account has been used for fraud or abuse, including creating multiple accounts, self-referrals, reselling rewards, or any violation of these Program Terms or our Terms of Service. Membership fees are not refunded in these cases.

13. Privacy

We use the information connected to your account, including your purchase history, Hearts activity, and birthday, to run the Program. Our Privacy Policy explains how we collect, use, and share your information.

14. Governing Law

These Program Terms are governed by the laws of the State of New York and applicable federal law of the United States, without regard to conflict of law principles.
